GENERAL TERMS AND CONDITIONS OF SALE

  • DEFINITIONS
  • Host: In these terms and conditions, the term “host” refers to the owner of the accommodation (legal entity: Société REVERSO 2023), who has delegated certain powers and responsibilities to different entities with which the traveller may potentially interact.
  • Traveller: refers to any adult natural person making a reservation for the accommodation through the various platforms, on their own behalf and/or on behalf of other beneficiaries, and who effectively occupies or is expected to occupy the accommodation in the context of a family and/or leisure stay.
  • House rules: refers to all rules of conduct, use of the premises and equipment, as well as safety instructions applicable within the rented accommodation. The house rules are communicated to the traveller via the rental platform and will also be physically available inside the accommodation. The house rules must be strictly observed throughout the entire stay.
  • Furniture: refers to all furnishing items of the accommodations, as well as the various equipment and household appliances provided in each accommodation unit.

Preliminary provisions

The host uses a service provider (concierge service), acting in the name and on behalf of the host, under its authority, for the execution of all or part of the services.
In all circumstances, the traveller may contact the concierge service or, if desired, the host’s representative directly.
Their contact details will be provided at check-in.

  • PURPOSE

The host offers short-term seasonal accommodation with para-hotel services.
This accommodation is governed by Article L324-2 of the French Tourism Code and falls within the scope of Article 261 D4°b of the French General Tax Code.

Para-hotel services are detailed under the “Price” section. Some are mandatory and included in the service, while others are considered optional paid services.

The accommodation capacity is set at a maximum of 14 persons, and any excess is strictly prohibited.

The traveller must use the reserved accommodation only for the purpose for which it was rented: exclusive and personal family use.

Providing access to third parties or subletting is strictly forbidden.

The traveller may not establish a main residence, conduct any professional activity, or receive clients in the accommodation.

It is forbidden to take or use photographs of the accommodation for commercial purposes.

  • DURATION

The length of stay is fixed after reservation confirmation and cannot exceed one month.
The traveller may not, under any circumstances, claim the right to remain in the premises after the stay period has ended.

Arrival: Unless otherwise agreed, the stay begins at 5:00 p.m. on the first day defined in the reservation with a welcome from the host’s representative.

Departure: The stay ends at 10:00 a.m. on the last reserved day with the return of keys, an inspection of the premises and settlement of optional services.

Early arrival or late departure may be possible subject to the property’s availability and the host’s approval. These options are not automatically included and must be requested in advance.

  • DESCRIPTION

Property: Premium chalet of 160 m²
Capacity: 14 beds

The CHOCOLAT chalet includes 5 double bedrooms and 1 dormitory with 4 beds; all six bedrooms are equipped with a shower room and toilets. Sheets and towels are provided. The living room is spacious and bright, furnished with sofas and armchairs. The kitchen is fully equipped with two coffee machines, two ovens, a microwave, a dishwasher and other appliances.

For guests comfort, the chalet also includes a washing machine, a dryer, hairdryers, a speaker and Wi-Fi.

A ski locker is available outside the chalet. A jacuzzi and outdoor chairs are also provided on the terrace.

  • Non-smoking property
  • Pets not allowed
  • The premises, classified as residential, are not suitable for persons with reduced mobility and are not considered tourist residences (as defined in Art. D321-1 of the Tourism Code).
  • INVENTORY OF FIXTURES

Check-in inspection:
The traveller is welcomed physically by the host.
A dated video “inventory of fixtures” showing all elements of the chalet will be made before or on the traveller’s arrival day. This serves as the official check-in inventory and is sent to the host’s representative by email at reservation@smartstay.fr. The traveller has 12 hours to report any damage by email to the same address.

Additionally, a digital welcome guide is sent to the traveller after the reservation.
The host provides equipment manuals and safety instructions via this digital guide. A table listing brands and references of all appliances is also shared.

Check-out inspection:
If damages are noted, repair or replacement costs will be deducted from the security deposit upon presentation of supporting documents by the host. If the deposit is insufficient, additional charges will apply.
No deductions are made without careful review.

In case of disagreement, the dispute will be handled under the section “Claims and Mediation”.
The traveller must immediately notify the host of any breakage or damage during the stay.

  • PRICE, BILLING AND OPTIONS

Base price includes:

  • Personalised welcome, property presentation, inspection and host contact details
  • Safety and usage instructions via the digital guide
  • Cleaning before arrival and after departure
  • Spare sheets and towels for emergencies
  • A welcome breakfast basket (composition varies with length of stay, typically including brioche, cereals, coffee, tea, milk, orange juice, jam and chocolate spread).

Optional services (additional fee):

  • Extra cleaning during stay
  • Renewal of supplies and towels
  • Grocery delivery
  • Special requests (transport, private chef, sports coach, babysitter)

Options can be requested at booking or during the stay. In both cases, full payment is required before services are delivered.

Total price includes:

  • Base stay price
  • Chosen options
  • Tourist tax

Utilities (normal use of water, electricity, gas and firewood) are included in the base rent.

The total price of the short-term stay is agreed and accepted as an all-inclusive amount, covering all standard charges, except for any excess consumption of water and energy.

A detailed description of the services and prices will be provided in the checkout invoice.

It is specified that the price of the stay is automatically subject to VAT, given the provision of at least three of the four para-hotel services referred to in Article 261 D 4° b of the French General Tax Code.
The host expressly declares that they have opted to be subject to VAT and waive the basic exemption (Article 293 F of the French General Tax Code).
The tax will be invoiced at the applicable rate.

  • CONSUMPTION

The consumption of water, firewood, gas, electricity or any other form of energy is included in the basic rent on a flat-rate basis, within the limits of normal use.

  • CANCELLATION CONDITIONS

Cancellation policies depend on the booking platform used for the CHOCOLAT chalet.

  • WIFI ACCESS

Wi-Fi is freely accessible.
By providing Wi-Fi codes, the host is considered an internet provider and must store communication data for one year.
Travellers must not use the connection for illegal downloads or illicit activities.

  • INSURANCE

The traveller declares holding a private family liability insurance (“holiday rental coverage”) covering damages caused by themselves or their family during the stay.
The host assumes no responsibility for accidents or theft of personal belongings.

  • NATURAL RISKS AND POLLUTION

The traveller acknowledges having taken note of the foreseeable natural risks listed by the local authority.

  • REGARDING THE NON-TRANSFERABILITY OF THIS CONTRACT

The transfer of this contract is strictly prohibited, as it is considered a contract intuitu personae.

  • GENERAL DATA PROTECTION REGULATION (GDPR)

Compliance with European Regulation No. 2016/679 and the Law of 20/06/2018:

All information requested from the traveller is collected solely for the purpose of providing accommodation and tailoring services to ensure their satisfaction.
Such data are strictly limited to the execution of the para-hotel contract and to any potential offers made within this exclusive framework.

The traveller has the right to access and rectify their personal data and may request their erasure at any time, where applicable.

The host obtains the traveller’s consent at the time of booking.
Any complaint may be submitted to the Commission Nationale de l’Informatique et des Libertés (CNIL), located at 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, Tel: +33 (0)1 53 73 22 22, or through its official website, www.cnil.fr.

  • CLAIMS AND MEDIATION

In case of disputes, parties shall attempt amicable settlement.
Claims must be sent by registered mail with acknowledgement of receipt.

The host acknowledges receipt within 10 working days and resolves within 60 days.

In accordance with Article L612-1 of the Consumer Code, the host guarantees the traveller free recourse to a consumer mediator: the National Association of Mediators (ANM) (https://www.anm-conso.com).

Failing mediation, competent courts may be seized.

  • HOUSE RULES – CHALET CHOCOLAT

1. General Conditions

The traveller undertakes to respect the premises, the neighbourhood and the common-sense rules applicable to a high-quality holiday rental.

These house rules form an integral part of the rental agreement. Failure to comply may result in deductions from the security deposit or, in serious cases, termination of the stay without refund.

2. Check-in and Check-out

Check-in: from 5:00 p.m.
Check-out: before 10:00 a.m.

Any arrival or departure outside these times must be agreed in advance.

3. Accommodation Capacity

The number of occupants may not exceed the capacity stated in the contract. In the event of non-compliance, the host reserves the right to refuse additional guests or to cancel the booking.

4. Para-hotel Services

The following services are included in your stay:

  • Cleaning: on arrival and departure (mid-stay cleaning available on request)
  • Linen: bed linen, towels and tea towels provided
  • Basic supplies: soap, toilet paper, cleaning products
  • Personalized welcome and inventory of fixtures

5. House Rules

  • Smoking is strictly prohibited inside the chalet.
  • Pets are not allowed.
  • Parties and noise disturbances are prohibited between 10:00 p.m. and 8:00 a.m.
  • Respect for peace and the neighbourhood is required.
  • The chalet must be left in a reasonable state of cleanliness (dishes washed, bins emptied, etc.).
  • Furniture must be left or replaced in the same position as on arrival.

6. Safety

  • Guests must ensure that the property is locked (doors and windows) whenever they leave and also at night before going to bed.
  • The property is equipped with an alarm system, which is only activated when the chalet is unoccupied. Guests are not required to handle it.
  • CCTV cameras are installed but only operate when the alarm system is engaged in the absence of guests.
  • Guests are requested to familiarise themselves with posted safety instructions and emergency numbers.
  • Children remain under the exclusive responsibility of their parents.
  • In the event of malfunction, breakage or accident, the host must be informed immediately.

In accordance with the Law of 6 July 1989 on rental relations, the traveller is obliged “to use the rented premises peacefully in accordance with the purpose stipulated in the rental contract and to refrain from any behaviour or activity which, in or around said premises, may damage communal facilities, compromise the safety of persons, or restrict their freedom of movement.”

Jacuzzi – Safety and Hygiene Rules

  • Always cover the jacuzzi with the safety cover when not in use, especially when leaving the premises.
  • Never place electrical appliances within 1.5 metres of the jacuzzi.
  • Consult a doctor before use if you have health issues or are undergoing medical treatment.
  • Showering before using the jacuzzi is mandatory.
  • Water temperature must not exceed 40°C. The ideal range is between 30°C and 37°C. If the temperature exceeds 37°C, leave the water after 15 minutes.
  • Eating and drinking in the jacuzzi are strictly prohibited.
  • The heat of the spa, combined with alcohol, drugs or medication, may cause loss of consciousness.
  • Children must always be supervised by an adult. They must not immerse their heads and must not remain in the water for more than 15 minutes if the temperature reaches 32°C.
  • Pregnant women must check the water temperature before use: do not enter if it exceeds 38°C, and leave after 10 minutes.
  • Leave the jacuzzi immediately if you feel discomfort, dizziness or drowsiness. Prolonged exposure may cause hyperthermia and loss of consciousness.
  • Please note that the jacuzzi is emptied and cleaned at the end of each stay.

Fireplace
The use of the fireplace is strictly prohibited. It is locked with a padlock, which guests are forbidden to tamper with.

7. Use of Facilities

Facilities available include a fully equipped kitchen, TV, Wi-Fi, swimming pool, jacuzzi, etc.

Any misuse of fire extinguishers or other equipment provided in the chalet may result in repair or replacement charges.

8. Damages and Security Deposit

Any breakage, loss or damage must be reported immediately.

In such cases, a security deposit may be required. It will be returned within 15 days after inspection of the property. If no deposit has been requested, the host may claim through the insurance schemes of the booking platforms.

9. Waste and Recycling

Please follow the selective waste-sorting rules established by the municipality.

10. Liability

The host accepts no responsibility for theft, loss or accidents occurring in or around the chalet during the traveller’s stay.

11. Acceptance

Booking the chalet implies full acceptance of these house rules.
